A legal fight over the government’s use of a secret surveillance tool has provided new insight into how the controversial tool works and the extent to which Verizon Wireless aided federal agents in using it to track a suspect.

Court documents in a case involving accused identity thief Daniel David Rigmaiden describe how the wireless provider reached out remotely to reprogram an air card the suspect was using in order to make it communicate with the government’s surveillance tool so that he could be located.

Rigmaiden, who is accused of being the ringleader of a $4 million tax fraud operation, asserts in court documents that in July 2008 Verizon surreptitiously reprogrammed his air card to make it respond to incoming voice calls from the FBI and also reconfigured it so that it would connect to a fake cell site, or stingray, that the FBI was using to track his location.

Air cards are devices that plug into a computer and use the wireless cellular networks of phone providers to connect the computer to the internet. The devices are not phones and therefore don’t have the ability to receive incoming calls, but in this case Rigmaiden asserts that Verizon reconfigured his air card to respond to surreptitious voice calls from a landline controlled by the FBI.

The FBI calls, which contacted the air card silently in the background, operated as pings to force the air card into revealing its location.

In order to do this, Verizon reprogrammed the device so that when an incoming voice call arrived, the card would disconnect from any legitimate cell tower to which it was already connected, and send real-time cell-site location data to Verizon, which forwarded the data to the FBI. This allowed the FBI to position its stingray in the neighborhood where Rigmaiden resided. The stingray then “broadcast a very strong signal” to force the air card into connecting to it, instead of reconnecting to a legitimate cell tower, so that agents could then triangulate signals coming from the air card and zoom-in on Rigmaiden’s location.

After three days of meetings with lawmakers on Capitol Hill, President Obama is shifting gears today, venturing outside the Beltway to deliver the first energy speech of his second term, one that will promote research into fossil fuel alternatives.

The president will promote his “all-of-the-above” energy strategy and plan to reduce the nation’s dependence on oil during a visit to the research facilities at Argonne National Laboratory outside Chicago in Argonne, Ill.

Obama is calling on Congress to establish a new Energy Security Trust, urging them to set aside $2 billion over ten years to support research into “cost-effective technologies.”

According to the White House, the trust is “designed to invest in breakthrough research that will make the technologies of the future cheaper and better – technologies that will protect American families from spikes in gas prices and allow us to run our cars and trucks on electricity or homegrown fuels.”

Double taxation is something Democrats love. Too bad criminals rarely buy the firearms they use in crimes from gun shops so this tax only affects law-abiding citizens of Cook County.

A group of Chicago area gun dealers and owners filed a lawsuit Thursday in Cook County Circuit Court, aiming to halt a new $25 tax on every gun purchase in Cook County.

The special county tax doesn’t kick in until April 1, but Chuck’s Gun Shop in south suburban Riverdale — one of the better-known gun stores in the area — is among the plaintiffs asking a judge to order the county to hold its fire. The suit says the tax a violation of the right to bear arms.

“Proponents of the tax have admitted that its purpose is to curb the number of firearms in circulation. The Tax thus is intended to deter individuals from exercising their fundamental right to keep and bear arms guaranteed by the Second and the Fourteenth Amendments to the United States Constitution and . . . the Illinois Constitution,” the lawsuit states.

The suit claims the tax infringes “on the right of law-abiding citizens to keep and bear, and law-abiding Retailers to sell, arms as guaranteed” by state and local constitutions.

“There’s enough taxes on those already — we pay a sales tax. [And] I had to pay $100 to qualify to purchase a gun — and I think I’ve paid enough,” said South Sider Deborah Gowder, referring to what she paid for a FOID permit just to purchase a gun. She and her son are both plaintiffs in the case.

DETROIT (WWJ/AP) — A federal judge has blocked the Obama administration from requiring Domino’s Pizza founder Tom Monaghan to provide mandatory contraception coverage to his employees under the federal health care law.

The devout Roman Catholic says he considers contraception “gravely immoral” practice. His lawsuit also lists as a plaintiff his Domino’s Farms, an office park outside Ann Arbor.

On Thursday, U.S. District Judge Lawrence Zatkoff granted a preliminary injunction against enforcement of the law against Monaghan and Domino’s Farms.

Monaghan has sold most of his controlling stake in Domino’s Pizza. He offers health insurance that excludes contraception and abortion for employees.

The new federal law requires employers to offer insurance including contraception coverage or risk fines.

The top U.S. immigration enforcement official acknowledged Thursday that the Obama administration has in fact released thousands of illegal immigrants from local jails over the last month despite prior claims that the release was only in the hundreds.

Immigration and Customs Enforcement Director John Morton, at a House appropriations subcommittee hearing, said the agency released a total of 2,228 illegal immigrants from local jails “throughout the country” between Feb. 9 and March 1 for “solely budgetary reasons.”

Morton is so bad that the ICE union gave him a vote of no confidence for his failure to enforce immigration laws.

For the first time, he explained the kinds of detainees that were sprung from local jails — he said they included detainees held on theft charges, financial criminals and drunken drivers.

“In some cases, multiple DUIs,” Morton acknowledged. He also said 10 individuals labeled as “Level 1″ offenders — the most serious classification — were released, but that four have since been brought back into custody. That category can include assault cases but Morton said the detainees were mostly in for financial offenses.

Morton stressed that the releases were made on a case-by-case basis and not “willy-nilly.”

“There are no mass releases of dangerous criminals under way or any plan for the future,” he said.

Team Obama lied…as usual…as they claimed they were not releasing criminals back onto the street…

[...]But Morton’s acknowledgement that more than 2,000 were released appeared to conflict with prior claims from the administration, which said it was only releasing hundreds.

The Associated Press first reported March 1 that the administration had released more than 2,000 illegal immigrants since at least Feb. 15 and planned to release 3,000 more in March due to looming budget cuts, but Homeland Security Secretary Janet Napolitano said days later that the AP’s report was “not really accurate” and that the story had developed “its own mythology.”

“Several hundred are related to sequester, but it wasn’t thousands,” Napolitano said March 4 at a Politico-sponsored event.

WASHINGTON (AP) — Jobs numbers and other benefits touted by supporters of the Keystone XL oil pipeline are probably exaggerated, President Barack Obama told House Republicans on Wednesday, according to lawmakers who attended the closed-door meeting.

But Obama did not rule out a decision to approve the $7 billion pipeline, according to participants.

Obama told Republicans at the Capitol that he’s still weighing a decision on the pipeline, which would carry oil from western Canada to refineries along the Texas Gulf Coast.

Really? Since when has Obama cared about jobs, temporary jobs or part-time jobs. Most of the jobs created have been part-time under his presidency. Obama wants higher energy and gas prices. Both are more expensive since he took over and both are skyrocketing which is his goal. He’s not worried about jobs or concerned with getting America free from Muslim oil. Nothing but a photo-op presidency.
