(Washington, DC) – Judicial Watch, the organization that investigates and fights government corruption, announced today that it filed a Freedom of Information Act (FOIA) lawsuit on January 3, 2012, against the Obama Department of Justice (DOJ) and U.S. Department of Housing and Urban Development (HUD) to obtain documents pertaining to accusations of fraud against the nation’s five largest mortgage companies and the creation of “federal accounts” to settle probes into faulty mortgage practices (Judicial Watch v. HUD and DOJ (No. 1:12-cv-0002)). The Obama administration has reportedly been engaged in settlement negotiations behind closed doors with mortgage companies that would result in at least $20 billion in payments from the nation’s major banks.

Pursuant to a Judicial Watch FOIA request filed with the DOJ and HUD on May 17, 2011, Judicial Watch seeks the following records:

• A set of government audits used to support allegations that the nation’s five largest mortgage companies of defrauding taxpayers in the handling of foreclosures on homes purchased with government-backed loans.

• A term sheet which outlined the Obama administration’s settlement offer to the mortgage companies accused of fraud. The terms described on this document allegedly included the creation of a federal account funded by the nation’s largest mortgage firms to help distressed borrowers avoid foreclosure and settle state and federal probes into alleged faulty mortgages practices.

The DOJ notified Judicial Watch by letter that the agency received the FOIA request on May 27, 2011. Under the law, a response from the DOJ was due within twenty working days, or by June 24, 2011. On September 22, 2011, the DOJ reported to Judicial Watch that it had located nine documents totaling 346 pages responsive to the FOIA request, but had referred the documents to HUD for processing and direct response.

A similar FOIA request was filed with HUD, also on May 17, 2011. According to a letter from HUD, the request had been received on May 18, 2011, which means that the response was due by June 16, 2011. On September 13, 2011, HUD indicated in a letter to Judicial Watch that under instruction from the DOJ “the records responsive to your request are being withheld in full…”

As Judicial Watch noted in its FOIA requests, in his “exclusive” May 16, 2011, article detailing the settlement negotiations with mortgage lenders, Huffington Post reporter Shahien Nasiripour referred specifically to the audits and the term sheet at issue in Judicial Watch’s FOIA lawsuit. According to the article, four federal agents briefed Nasiripour on the “set of confidential audits,” while the confidential term sheet “was reviewed” by the Huffington Post.

In addition to conducting behind-the-scenes negotiations with the mortgage lending industry, the Obama administration is also reportedly pressuring state attorneys general to close down their investigations and sign off on the deal. Judicial Watchpreviously obtained documents calling into question the veracity of testimony by Elizabeth Warren, a then-Obama administration official, about the involvement of the new Consumer Production Financial Bureau in these negotiations.

Bloomberg reports:

President Barack Obama “walked away” from his bipartisan U.S. deficit-cutting commission’s plan “because he knew he’d be torn to bits,” said former Republican Senator Alan Simpson, who was co-chairman of the panel.

Obama is “terrified” of the deficit issue, Simpson said in an interview on Bloomberg Television’s “Political Capital with Al Hunt,” airing this weekend. “He didn’t deal with it” in his annual State of the Union address to Congress on Jan. 24.

Jamie Smith, a White House spokeswoman, declined to comment.

…A budgetary time bomb is set to go off at the end of this year when Bush-era tax cuts will expire, slashing Americans’ paychecks. At the same time, $1 trillion in automatic cuts in government spending will begin taking effect in January.

The spending reductions were designed to be so draconian that they would force a budget-cutting “supercommittee” to agree on a plan for reducing the government’s trillion-dollar deficits. Like a succession of budget-reducing groups before it, the panel deadlocked last year over proposed tax increases and cuts to politically sensitive programs such as Medicare.

INDIANAPOLIS (AP) — Protesters of a divisive labor measure have marched through the packed Super Bowl Village in downtown Indianapolis.

A mix of union members and Occupy protesters from across Indiana led a rally Saturday that began at the Statehouse before weaving through the crowded pre-game attraction. Speakers at the rally included two state representatives, a state senator and several union workers.

Indianapolis Education Association President Ann Wilkins told the crowd of about 75 protesters to remember which legislators voted for the right-to-work bill and vote them out in the November elections.

Law-abiding Mexicans who want a gun to defend themselves have no good options. Either they fight government red tape to get a legal permit, or they buy one on the black market.

After an outbreak of violence, one embattled community in northern Mexico called Colonia LeBaron has begun to ask if it’s time for the country to address its gun laws.

Vice President Joe Biden spoke to a conference of House Democrats in Maryland today, and in discussing the SEAL Team raid that successfully took out Osama bin Laden, he admitted that he advised President Obama not to carry out the mission because “we have to do more things to see if he’s there.” The vice president gave an insider account of the internal discussions in the White House before the order was officially carried out.

Biden praised the president for having a “backbone like ramrod” before giving a point-by-point recollection of everything that happened in the final day before Obama gave the SEAL team its orders.

“The President, he went around the table with all the senior people including the Chiefs of Staff. He said, I have to make this decision what is your opinion. He started with the National Security adviser, the Secretary of State and he ended with me. Every single person in that room hedged their bet, except Leon Panetta. Leon said GO. Everyone else said 49, 51, this…

It got to me. Joe what do you think? I said ‘You know I didn’t know we have so many economists around the table. We owe the man a direct answer. Mr. President my suggestion is don’t go. We have to do two more things to see if he’s there.’”

For the first time, the Justice Department has made public a series of sensitive messages that passed to the highest levels of the agency within hours of an ambush that killed a U.S. border patrol agent along the Southwest border in December 2010, igniting a national scandal over a gun trafficking investigation gone wrong.

Justice officials sent the documents to Congress late Friday evening, only a few days before Attorney General Eric Holder isset to testify before the House Oversight and Government Reform Committee.

The email messages show the former top federal prosecutor in Arizona, Dennis Burke, notifying an aide to Holder via email on Dec. 15, 2010 that agent Brian Terry had been wounded and died. “Tragic,” responds the aide, Monty Wilkinson. “I’ve alerted the AG, the acting Deputy Attorney General…”

More evidence that AG Holder perjured himself. Holder openly bragged about the operation but when he testified, he told Congress that he had only gained knowledge a few weeks prior. He’s known since April 2009. This gun trafficking scheme was paid for by Obama’s stimulus.

Only a few minutes later, Wilkinson emailed again, saying, “Please provide any additional details as they become available to you.”

Burke then delivered another piece of bad news: “The guns found in the desert near the murder [sic] … officer connect back to the investigation we were going to talk about — they were AK-47s purchased at a Phoenix gun store.”

WASHINGTON (Reuters) – The Justice Department issued civil subpoenas to 11 financial institutions as part of a new effort to investigate misconduct in the packaging and sale of home loans to investors, Attorney General Eric Holder said on Friday.

Holder declined to provide specifics, including the names of the firms.

“We are wasting no time in aggressively pursuing any and all leads,” Holder said at a news conference announcing details of a new working group to investigate misconduct in the residential mortgage-backed securities (RMBS) market, “you can expect more to follow.”

President Barack Obama said he directed Holder to create the new unit in his State of the Union speech late Tuesday, saying it was needed to “help turn the page on an era of recklessness.”

On Friday a slew of federal and state officials appeared at the news conference to provide details about the new group.

Housed within an earlier financial fraud task force that Obama created in 2009, it is expected to be staffed with around 50 attorneys, analysts and agents, officials said.

Two task forces?

Some skeptics have questioned whether the new group is largely a political move because the other fraud task force already exists.

Also, the Obama administration has received heat from left-leaning activist groups that believe a separate effort to investigate misconduct in processing foreclosures and servicing home loans may not be rigorous enough to extract a meaningful settlement.

In exchange for providing up to $25 billion in housing relief, much in the form of cutting mortgage debt for distressed borrowers, the top U.S. banks are expected to put behind them government lawsuits about lending and servicing abuses – but not securitization claims.

The banks involved in the discussions include Bank of America, Wells Fargo & Co, JPMorgan Chase & Co, Citigroup and Ally Financial Inc.

All who gave Obama more campaign cash than any other candidate in history.

WASHINGTON, D.C. – Oversight and Government Reform Committee Chairman Darrell Issa demanded in letter to Attorney General Holder that the Justice Department make Arizona U.S. Attorney’s Office Assistant United States Attorney Michael Morrissey available to speak with Committee investigators about his role in and knowledge of Operation Fast and Furious. His supervisor, Patrick Cunningham, has stated he will exercise his Fifth Amendment and refuse to answer any questions pertaining to Operation Fast and Furious – such an assertion is extremely rare and suggests possible criminal culpability on the part of a high ranking Justice Department official. Morrissey, who reported directly to Cunningham’s and was intimately involved with Operation Fast and Furious.

“Since August, the Department has identified Patrick Cunningham as the best person in the U.S. Attorney’s Office to provide information about Fast and Furious to the Committee,” Issa said in his letter to Holder. “The Department has refused to make Michael Morrissey and Emory Hurley, both Assistant United States Attorneys supervised by Mr. Cunningham, available to speak with the Committee, citing a policy of not making “line attorneys” available for congressional scrutiny. Mr. Morrissey, however, was Mr. Hurley’s direct supervisor, and an integral part of Fast and Furious. Importantly, both Morrissey and Hurley are unique in their possession of key factual knowledge about Fast and Furious not readily available from any other source.”

The Chairman also reiterated that the Justice Department still has not complied with the subpoenas issued to date, including subpoenaed documents from Cunningham, Morrissey and Hurley.
